However, there are several shortcomings with this charter in regards to situations that are out of the airline&#8217;s control.<\/p>\n<p>For example, the labour shortage is a carrier-driven situation. However, if the underlying cause is a COVID-19 outbreak among the crew, would the lack of personnel then be considered a circumstance out of control?<\/p>\n<p>[\/vc_column_text][vc_single_image image=&#8221;148916&#8243; img_size=&#8221;large&#8221; alignment=&#8221;center&#8221; style=&#8221;vc_box_rounded&#8221;][vc_column_text el_class=&#8221;checkmarks&#8221;]<\/p>\n<p>As a result, the <a target=\"_blank\" href=\"https:\/\/otc-cta.gc.ca\/fra\">Canadian Transportation Agency<\/a> has just announced changes to better protect passengers in the event of a flight delay or cancellation beyond the control of the carrier.<\/p>\n<p>These <a target=\"_blank\" href=\"https:\/\/otc-cta.gc.ca\/fra\/apercu-reglement-modifiant-reglement-sur-protection-des-passagers-aeriens\">changes<\/a> took effect on September 8, 2022.<\/p>\n<p>[\/vc_column_text][vc_custom_heading text=&#8221;Review of the Air Passenger Protection Regulations&#8221; google_fonts=&#8221;&#8221; el_id=&#8221;review_of_the_air_passenger_protection_regulations&#8221;][vc_column_text el_class=&#8221;checkmarks&#8221;]<\/p>\n<p>The <strong>Air Passenger Protection Regulations<\/strong> are a passenger bill of rights that dictate the minimum obligations that airlines must fulfill to the travelling public.<\/p>\n<p>All airlines operating flights to and from Canada must comply.<\/p>\n<p>[\/vc_column_text][vc_message]<\/p>\n<p>This article discusses the <strong>Air Passenger Protection Regulations<\/strong> and the compensation you may receive following a flight delay or cancellation. This rule applies to youth under the age of 14. The latter (their aircraft or another airline) must be within 48 hours of the departure time of your initial flight.<\/p>\n<p>If the airline is unable to rebook you on another flight within the 48-hour window, you will have the option of receiving a refund or booking a later flight.<\/p>\n<p>However, there will be no compensation if the cause of the delay is beyond their control.<\/p>\n<p>Finally, if you request a refund, it must be given to you within 30 days.<\/p>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_custom_heading text=&#8221;The method of reimbursement&#8221; font_container=&#8221;tag:h3|text_align:left&#8221; google_fonts=&#8221;&#8221; el_id=&#8221;the_method_of_reimbursement&#8221;][vc_column_text el_class=&#8221;checkmarks&#8221;]<\/p>\n<p>Effective September 8, 2022, if the carrier cannot issue you a new confirmed ticket within 48 hours of your original departure, you may request a refund.<\/p>\n<p>A refund of the unused portion of the ticket must be made in the original form of payment for flight delays and cancellations for reasons beyond the airline&#8217;s control. The carrier may also issue a travel credit if and only if it does not have an expiration date.<\/p>\n<p>[\/vc_column_text][\/vc_column][\/vc_row][vc_row][vc_column][vc_custom_heading text=&#8221;Changes to the Air Passengers Protection Regulations (September 2023)&#8221; google_fonts=&#8221;&#8221; el_id=&#8221;changes_to_the_air_passengers_protection_regulations_september_2023_&#8221;][vc_column_text]<\/p>\n<p>In a <a target=\"_blank\" href=\"https:\/\/www.canada.ca\/en\/transport-canada\/news\/2023\/04\/minister-of-transport-presents-proposed-amendments-to-the-canada-transportation-act-to-strengthen-air-passenger-rights-and-simplify-the-complaint-r.html\">press release<\/a>, the government has proposed certain changes to the APPR that could be in effect as of September 30, 2023.<\/p>\n<p>Basically, these changes are intended to close the various loopholes with the current rules so that passengers can be compensated more easily. Indeed, when the RPPA was introduced in 2019, airlines had to compensate their customers when a delay or cancellation occurred within their control such as a lack of crew for example.<\/p>\n<p>However, events beyond their control such as weather or security-related issues were not eligible for compensation.
